2 October—Yesterday’s disquisition teased you about snail mail Judge Peloquin sent to my son, Paul Morreiricca Rosenberg (pronounced Mariachi, as in the Mexican folk music). So. Hizzoner sent what appears to be the original IRS reminder to him (i.e., not a copy) that his and his wife’s jointly unpaid federal taxes, dating back to 2009 and 2014, were due by 13 August, lest his (their) Social Security and any other scratch he (they) might be getting from the fed be withheld under the Federal Payment Levy Program.
The reminder is annotated, presumably by Judge Peloquin himself. The annotations include a probable allusion to the $487,899.22 in federal tax liens filed with Litchfield’s Town Clerk and reproduced in the 12 May disquisition. He claims the overdue taxes amounted to only $55,876. 81 and were paid.
The overdue taxes may well have been paid by 13 August. But if so, why isn’t the release filed with Litchfield’s Town Clerk? That’s supposed to be done within 30 days. Note that the unpaid taxes referred to in the IRS reminder are only those due in 2009 and 2014, $45,929.67, plus (presumably) interest and penalties totaling $9,947.14, but don’t include the other $432,022.41 of the liens filed with Litchfield’s Town Clerk.
Both the Internal Revenue Code and Connecticut General Statutes provide that, in the words of CGS, “Notices of liens upon real property for taxes payable to the United States and notices of liens upon real property for costs and damages payable to the United States, and certificates and notices affecting such liens shall be filed in the office of the clerk of the town in which the real property subject to a federal tax lien or other federal lien is situated.”
So what are we to conclude? Remains to be seen.
Moving on, then, Judge Peloquin was good enough to enclose with the annotated IRS reminder a copy of the Litchfield Planning and Zoning Commission’s legal notice of 26 February 1981 approving the zone change from R40 to RMF160 that paved the way (pun intended) for the Litchfield Ponds condos. Cathy Laper was chair back then. Brings back memories.
Hizzoner also enclosed a zoning map of the area of his proposed Moose Creek condos. The Moose Creek site is just across Milton Road from Litchfield Ponds with 63 units and adjacent to the Westleigh condos with 66 units. Peloquin proposes 102 units for Moose Creek’s 39 acres. That’s roughly the size of Litchfield Ponds and Westleigh combined and roughly the same intensity of land use, though adding pressure to existing town roads, sewers, and water lines. But probably not adding many kids to the schools while enhancing the grand list.
Or there’s affordable housing, as Peloquin has threatened in his inimitable way, to royally screw Litchfield. And given Connecticut Democrats’ tripartite push for forced affordable housing and the agendas of all the judges appointed by them, Litchfield’s P&Z should seriously consider compromise with Peloquin and his bankers, lest the town be overrun with involuntary, undesirable affordable housing and scores of new kids to educate at taxpayer expense.
Don’t ask about “Be a good boy” . . .
